Terms and Conditions

Last updated: September 11, 2026

Welcome to Hyakki. These Terms and Conditions (“Terms”) govern purchases made through the Hyakki website and your use of our online store.

By placing an order with Hyakki, you agree to these Terms. Please read them carefully before completing your purchase.

1. About Hyakki

Hyakki is operated by a company registered in Denmark.

Company name: AIVIA
Trading name: Hyakki
CVR number: DK35982035

These Terms apply primarily to orders placed by customers located in the United States.

2. Products and Print-on-Demand Production

Hyakki sells apparel and related products that are produced using a print-on-demand model.

This means products are generally produced specifically after an order has been placed rather than being taken from a stock of pre-produced finished goods.

Because of the nature of print-on-demand production, slight variations may occur between products. Minor differences in print placement, color, appearance, or other production characteristics that are normal for the printing and manufacturing process are not necessarily considered defects.

We make reasonable efforts to display product colors and images accurately. However, colors may appear differently depending on your screen, device, and display settings.

3. Sizing

Please choose your size carefully before placing an order.

Size guides and measurements are provided on our website to help you select the appropriate size. Customers are responsible for reviewing the applicable size guide before ordering.

Because our products are made on demand, we do not accept returns, exchanges, or provide refunds simply because the customer selected the wrong size, the product does not fit as expected, or the customer changes their mind about the size.

If the size you receive is different from the size you ordered, please contact us as described under Section 8, “Defective, Damaged, or Incorrect Products.”

Nothing in this section limits any rights you may have under applicable law for products that are defective, damaged, incorrectly supplied, or materially different from what was ordered.

4. Orders

By submitting an order, you are making an offer to purchase the products shown in your order.

After placing an order, you may receive an automated order confirmation. An order confirmation acknowledges that we have received your order but does not necessarily mean that we have accepted it.

We reserve the right to reject or cancel an order where reasonably necessary, including in cases of suspected fraud, payment problems, obvious pricing or product-description errors, product unavailability, or an inability to fulfill the order.

If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled portion of the order.

5. Prices and Payment

Prices are displayed in the currency indicated on the website, typically U.S. dollars for customers shopping from the United States.

Applicable shipping charges and taxes, where collected by us, will be displayed during checkout before you complete your purchase.

You are responsible for providing accurate billing and payment information.

Payment must be successfully authorized before an order can be processed.

6. Shipping and Delivery

Estimated production and delivery times shown on our website are estimates and are not guaranteed delivery dates unless expressly stated otherwise.

Because products are made on demand, orders may require a production period before shipment.

Once an order has shipped, delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather, customs procedures, peak shipping periods, or incorrect delivery information supplied by the customer.

You are responsible for providing a complete and accurate shipping address.

If an order cannot be delivered because the customer provided an incorrect or incomplete address, additional costs for replacement or reshipment may be charged to the customer where permitted by law.

Nothing in this section limits rights you may have under applicable law regarding merchandise that is not delivered.

7. Returns, Exchanges, and Change-of-Mind Purchases

Unless otherwise required by applicable law or expressly stated by Hyakki, all sales are final once an order has entered production.

In particular, we generally do not accept returns or exchanges for:

  • incorrect size selection by the customer;
  • products that fit differently from the customer’s expectations where the correct ordered size was supplied;
  • change of mind;
  • preference for another color, design, or product after ordering; or
  • other reasons unrelated to a defect, damage, or fulfillment error.

Please review your order carefully, including the product, design, color, quantity, shipping address, and especially the size, before completing checkout.

This policy does not apply where a return, replacement, refund, or other remedy is required by applicable law.

8. Defective, Damaged, or Incorrect Products

If your product arrives defective, damaged, misprinted, or materially different from what you ordered, please contact us as soon as reasonably possible after receiving the order.

Please provide:

  • your order number;
  • a description of the issue; and
  • clear photographs showing the product and the problem.

We may request additional information reasonably necessary to investigate the issue.

If we determine that the product is defective, damaged, incorrectly produced, or that we sent you an item materially different from what you ordered, we will provide an appropriate remedy, which may include a replacement or refund, depending on the circumstances and applicable law.

A product fitting differently from expected is not considered defective when the product corresponds to the size ordered and the applicable product specifications.

9. Order Changes and Cancellations

Because orders may enter production shortly after being placed, we cannot guarantee that an order can be changed or cancelled after checkout.

If you notice an error in your order, contact us immediately.

If production has not yet started, we may be able to change or cancel the order. Once production has begun, changes or cancellations may no longer be possible.

10. Promotions and Discount Codes

Promotions and discount codes are subject to any additional conditions communicated with the promotion.

Unless otherwise stated, discount codes cannot be combined, have no cash value, and cannot be applied retroactively to completed orders.

We reserve the right to cancel or refuse a promotion where it has been used fraudulently, unlawfully, or contrary to its stated terms.

11. Intellectual Property

All content made available through Hyakki, including original designs, artwork, graphics, logos, branding, photographs, text, and other materials, is owned by or licensed to Hyakki and is protected by applicable intellectual property laws.

You may not reproduce, distribute, sell, commercially exploit, or create unauthorized derivative works from our protected content without prior written permission.

Purchasing a product does not transfer any intellectual property rights in the artwork, design, branding, or other content appearing on that product.

12. Website Information

We try to ensure that product descriptions, prices, images, availability, and other information on our website are accurate.

Occasionally, information may contain errors or omissions. Where permitted by law, we reserve the right to correct obvious errors and update information.

Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Hyakki will not be liable for indirect, incidental, special, or consequential losses arising from the purchase or use of our products or website.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

14. Privacy

Personal information collected through our website and in connection with your purchases is handled in accordance with our Privacy Policy.

Please review the Privacy Policy for information about the personal information we collect, why we collect it, how it is used, and your rights regarding that information.

15. Third-Party Service Providers

We may use third-party providers to support our business, including payment processing, website hosting, order fulfillment, printing, shipping, analytics, and customer service.

Your information may be shared with these providers where reasonably necessary to process and fulfill your order or operate our services, subject to our Privacy Policy and applicable law.

16. Force Majeure

We will not be responsible for delays or failure to perform caused by events outside our reasonable control, including natural disasters, severe weather, war, civil unrest, government actions, labor disruptions, carrier interruptions, supply-chain disruptions, telecommunications failures, or similar events.

This provision does not affect rights that cannot be excluded under applicable law.

17. Governing Law

These Terms and any contract between you and Hyakki are governed by the laws of Denmark, without regard to its conflict-of-law principles, except to the extent that mandatory consumer protection laws applicable to you provide otherwise.

Nothing in these Terms is intended to deprive a consumer of mandatory rights or protections that apply under applicable law.

18. Changes to These Terms

We may update these Terms from time to time.

The Terms applicable to your purchase are the version in effect when you place your order, unless a change is required by law.

The current version will be published on our website together with its effective or “last updated” date.

19. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

20. AI-Assisted Designs

Hyakki may use artificial intelligence (“AI”) tools as part of the creative and design process for certain products, artwork, graphics, illustrations, and other content available through our store.

AI tools may be used to generate, develop, modify, enhance, or assist with visual concepts and design elements. Designs may also be further edited, arranged, combined, or otherwise developed by Hyakki before being offered on our products.

By purchasing from Hyakki, you acknowledge that some designs or elements of designs may have been created or developed with the assistance of AI technologies.

We make reasonable efforts to ensure that the designs we offer do not knowingly infringe the intellectual property rights of third parties.

Nothing in this section grants customers any ownership or intellectual property rights in Hyakki designs, artwork, branding, or other content beyond ownership of the physical product purchased.
